How much can a landlord charge?

Ohio law does not cap the amount of a security deposit.

When must the deposit be returned?

Within 30 days after the rental agreement ends and possession is delivered, the landlord must return the deposit and/or give the tenant an itemized written notice of deductions.

Key rules

  • The tenant should give the landlord a forwarding address in writing.
  • If the deposit is more than $50 or one month's rent (whichever is greater) and the tenant stays at least six months, the landlord owes 5% annual interest on the excess.
  • Deductions are limited to past-due rent and damages from the tenant's noncompliance.

If the landlord doesn't follow the law

A tenant may recover the amount wrongfully withheld, plus an equal amount in damages and reasonable attorney's fees.
