Terms of Service

1. ACCEPTANCE OF TERMS

By accessing or using FlagMyLease ("the Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree, do not use the Service.

2. ELIGIBILITY

You must be at least 18 years of age to use the Service. By using the Service, you represent that you are at least 18 years old.

3. DESCRIPTION OF SERVICE

FlagMyLease is a web-based educational tool that uses artificial intelligence to analyze residential lease documents and provide general information about lease terms and tenant rights laws.

4. USER ACCOUNTS

4.1. You must create an account to use the analysis features of the Service.

4.2. You are responsible for maintaining the confidentiality of your account credentials.

4.3. You agree to provide accurate information when creating your account.

5. NATURE OF SERVICE — NOT LEGAL ADVICE

5.1. FlagMyLease provides general educational information about residential lease terms and tenant rights laws. FlagMyLease is NOT a law firm, does NOT practice law, and does NOT provide legal advice or legal representation.

5.2. No attorney-client relationship, fiduciary relationship, or other professional relationship is formed between you and FlagMyLease by your use of this service.

5.3. The information provided through the Service is general in nature and may not reflect the current state of the law in your jurisdiction. Laws change frequently, and local ordinances may provide additional protections or requirements not addressed by the Service.

5.4. The Service's identification of lease terms as "standard," "caution," or "red flag" reflects general comparisons to common lease terms and publicly available legal standards. These classifications do not constitute a legal opinion about the enforceability, legality, or advisability of any specific lease provision in your situation.

5.5. You should not rely solely on information provided by FlagMyLease when making decisions about your lease. For advice specific to your situation, consult a licensed attorney or tenant rights organization in your jurisdiction.

5.6. FlagMyLease does not recommend that you sign, refuse to sign, or modify any lease. All such decisions are yours alone.

6. PAYMENTS AND REFUNDS

6.1. The Service charges a one-time fee per lease analysis as displayed at the time of purchase.

6.2. Payments are processed by Stripe. FlagMyLease does not store your payment card information.

6.3. Because analysis results are delivered immediately upon payment, refunds are generally not available. If you experience a technical issue preventing delivery of your analysis, contact support@flagmylease.com.

7. DISCLAIMER OF WARRANTIES

7.1. THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, COMPLETENESS, OR NON-INFRINGEMENT.

7.2. FLAGMYLEASE DOES NOT WARRANT THAT THE SERVICE WILL IDENTIFY ALL RELEVANT LEASE PROVISIONS, THAT ALL LEGAL INFORMATION PROVIDED WILL BE CURRENT OR COMPLETE, OR THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF HARMFUL COMPONENTS.

7.3. FLAGMYLEASE MAKES NO REPRESENTATION OR WARRANTY REGARDING THE OUTCOME OF ANY DECISION YOU MAKE BASED ON INFORMATION PROVIDED BY THE SERVICE.

8. LIMITATION OF LIABILITY

8.1. TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, FLAGMYLEASE AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, AND AFFILIATES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF HOUSING OPPORTUNITIES, FINANCIAL LOSSES FROM LEASE TERMS, OR DAMAGES ARISING FROM RELIANCE ON INFORMATION PROVIDED THROUGH THE SERVICE, REGARDLESS OF THE CAUSE OF ACTION OR THE THEORY OF LIABILITY.

8.2. TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, FLAGMYLEASE'S TOTAL AGGREGATE LIABILITY ARISING OUT OF OR RELATING TO YOUR USE OF THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID TO FLAGMYLEASE FOR THE SERVICE IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR FIFTY DOLLARS ($50.00), WHICHEVER IS GREATER.

8.3. THE SERVICE IS PROVIDED FOR INFORMATIONAL AND EDUCATIONAL PURPOSES ONLY. YOU ACKNOWLEDGE THAT THE SERVICE MAY NOT IDENTIFY ALL PROVISIONS IN YOUR LEASE THAT MAY BE RELEVANT TO YOUR INTERESTS, AND THAT NO AUTOMATED ANALYSIS CAN SUBSTITUTE FOR REVIEW BY A QUALIFIED ATTORNEY.

8.4. YOU ASSUME ALL RISK ASSOCIATED WITH YOUR DECISION TO SIGN, NOT SIGN, OR NEGOTIATE ANY LEASE BASED IN WHOLE OR IN PART ON INFORMATION PROVIDED BY THE SERVICE.

9. INDEMNIFICATION

You agree to indemnify, defend, and hold harmless FlagMyLease and its officers, directors, employees, agents, and affiliates from and against any claims, liabilities, damages, losses, costs, and expenses (including reasonable attorneys' fees) arising out of or relating to: (a) your use of the Service; (b) your reliance on information provided by the Service; (c) any dispute between you and your landlord, property manager, or any third party; or (d) your violation of these Terms.

10. DISPUTE RESOLUTION

10.1. Any dispute arising out of or relating to these Terms or the Service shall be resolved through binding arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules, except that either party may seek injunctive relief in any court of competent jurisdiction.

10.2. OPT-OUT RIGHT: You may opt out of this arbitration provision by sending written notice to support@flagmylease.com within 30 days of first accepting these Terms. If you opt out, disputes will be resolved in the courts of the State of Delaware.

10.3. Class Action Waiver: To the maximum extent permitted by law, all claims must be brought individually, not as part of a class, collective, or representative proceeding.

11. USER REPRESENTATIONS

By using the Service, you represent and warrant that: (a) you are at least 18 years of age; (b) you are uploading a lease to which you are a party, for the purpose of reviewing its terms against applicable law; (c) you have the right to upload and share the lease document with the Service; (d) you understand that the Service provides general legal information only and not legal advice; (e) you will not rely solely on the Service when making decisions about your lease.

12. USER CONTENT

12.1. You retain all ownership rights to the lease documents you upload to the Service.

12.2. By uploading a lease document, you grant FlagMyLease a limited, non-exclusive, temporary license to process the document solely for the purpose of providing you with the lease analysis service. This license terminates when the analysis is complete and the document is deleted from our systems.

12.3. FlagMyLease may retain anonymized, aggregated statistical data derived from lease analyses for the purpose of improving the Service and publishing general market reports. Such aggregated data will not include any personally identifiable information or any text from your specific lease document.

13. MODIFICATIONS TO TERMS

FlagMyLease reserves the right to modify these Terms at any time. We will provide notice of material changes by posting the updated Terms on the Service. Your continued use of the Service after such posting constitutes acceptance of the modified Terms.

14. GOVERNING LAW

These Terms shall be governed by the laws of the State of Delaware, without regard to its conflict of laws provisions.
